TERMS OF SERVICE

1. Agreement to Terms

By accessing or using factcard.me (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Factcard provides a platform for creating professional profile pages that are optimized for discovery by AI assistants (such as ChatGPT, Perplexity, Claude, and Google AI). The Service includes profile creation, structured data generation, search engine submission, and hosting of your profile at a unique URL on factcard.me.

3. Account Registration

To use the Service, you must create an account. You agree to:

  • ▶Provide accurate and complete registration information
  • ▶Maintain the security of your account credentials
  • ▶Accept responsibility for all activity under your account
  • ▶Notify us immediately of any unauthorized use of your account

4. Payment & Pricing

The Service is offered as a one-time payment of $29 USD. This payment covers profile creation, hosting, AI optimization, and maintenance for a period of three (3) years from the date of purchase.

All payments are processed securely through Stripe. We do not store your payment card details.

Right of Withdrawal (EU Consumers)

Under the EU Consumer Rights Directive (2011/83/EU), you have a 14-day right of withdrawal for online purchases.

By checking the consent box during checkout, you expressly request that the Service is made available to you immediately upon purchase. You acknowledge that this means you lose your 14-day right of withdrawal once the Service has been made available to you.

If you complete your purchase but have not yet accessed or used the Service, you may request a full refund within 14 days of purchase by contacting support@factcard.me. No reason is required.

5. Your Content

You retain ownership of all content you submit to the Service (text, images, links, etc.). By publishing your profile, you grant Factcard a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your content for the purpose of operating the Service.

Public by design: Your published profile is intentionally made public and accessible to AI systems, search engines, and anyone on the internet. This includes structured data formats (JSON-LD, llms.txt, markdown) specifically designed for machine consumption. Do not include information you wish to keep private.

6. Acceptable Use

You agree not to use the Service to:

  • ✗Submit false, misleading, or fraudulent profile information
  • ✗Impersonate another person or entity
  • ✗Upload content that infringes on intellectual property rights
  • ✗Upload content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • ✗Attempt to gain unauthorized access to the Service or its systems
  • ✗Use the Service for any illegal purpose
  • ✗Interfere with or disrupt the Service or its infrastructure

7. AI Discoverability

Factcard uses third-party AI services to provide features such as profile import and chat preview. AI-generated content may contain inaccuracies. You are responsible for reviewing and approving all content before publishing your profile.

Factcard optimizes your profile for discoverability by AI assistants and search engines but does not guarantee that any specific system will index or cite your profile. We are not responsible for how third-party systems interpret or present your data.

8. Termination

Termination by You

You may request deletion of your account and all associated data at any time by contacting us at support@factcard.me. Upon deletion, your profile will be removed from the platform, and we will request de-indexing from search engines and AI systems.

Termination for Violation

We reserve the right to suspend or terminate your account, without refund, if you violate these Terms of Service. We will notify you of the reason for suspension or termination.

Discontinuation of Service

Factcard reserves the right to discontinue the Service with at least 6 months' prior notice. In such event, affected users will be notified by email and profile data will be made available for export in a structured, machine-readable format before the Service is shut down.

9. Intellectual Property

The Service, including its design, code, branding, and underlying technology, is owned by Factcard and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

10. Limitation of Liability

The Service is provided “as is” without warranties of any kind, except as required by applicable law. To the fullest extent permitted by law, Factcard is not liable for any indirect, incidental, or consequential damages, nor for any inaccuracies in AI-generated content, or how third-party systems display or fail to display your profile. Our total liability shall not exceed the amount you paid for the Service.

EU consumers: Nothing in these Terms affects your statutory rights under applicable consumer protection laws.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Sweden.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
